These Terms of Service constitute a legally binding agreement between you ("you" or "User") and SuperSit ("Company", "we", "us", or "our"), concerning your access to and use of the SuperSit desktop application, the SuperSit website, and any related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.

We reserve the right to modify these Terms of Service from time to time. If we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms.

Section 2

Eligibility

The Service is intended for users who are 18 years of age or older.

By using the Service, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into these Terms.
  • Your use of the Service complies with all applicable laws and regulations.

Persons under 18 are not permitted to use or register for the Service.

Section 3

Description of the Service

SuperSit is a desktop application that uses artificial intelligence and your device's webcam to monitor your sitting posture and provide real-time feedback intended to help you become more aware of your posture while working at a computer.

The Service may provide features including:

  • AI-powered posture monitoring
  • Webcam-based posture detection
  • Real-time posture alerts
  • Posture scores and feedback
  • Progress tracking and analytics
  • Streaks, XP, and levels
  • Other features and functionality that may be added or changed over time

SuperSit is designed as a posture awareness and habit-building tool.

Important Information About Webcam Use

The Service requires access to your device's webcam for posture monitoring to function.

Where the Service performs posture detection using on-device processing:

  • Webcam processing occurs locally on your device.
  • Webcam images and video are not transmitted to our servers for posture analysis.
  • We do not intentionally store or record your webcam feed for posture monitoring.
  • We do not have access to your live webcam feed through the posture monitoring feature.
  • You can disable webcam access at any time through your device settings.

Certain other Service features may require an internet connection or transmit information separately from webcam posture processing. Please review our Privacy Policy for details.

Section 4

Intellectual Property Rights

Unless otherwise indicated, the Service and all associated software, source code, databases, functionality, website designs, graphics, photographs, videos, audio, text, trademarks, logos, and other content are owned by or licensed to SuperSit and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal use, subject to these Terms and your applicable subscription.

You may not:

  • Copy or reproduce the Service except as permitted by law.
  • Resell, sublicense, lease, or distribute the Service.
  • Modify or create derivative works based on the Service.
  • Make the Service available to third parties.
  • Attempt to extract or reproduce proprietary source code.
  • Use the Service to create a substantially similar competing product.

All rights not expressly granted to you are reserved by SuperSit.

Feedback

If you provide suggestions, ideas, feature requests, or other feedback regarding the Service, you agree that we may use such feedback to improve or develop the Service without obligation to compensate you.

User Representations

By using the Service, you represent and warrant that:

  • Information you provide to us is accurate and complete.
  • You will maintain the accuracy of your account information.
  • You meet the eligibility requirements described in these Terms.
  • You will comply with these Terms.
  • You will comply with all applicable laws and regulations.
  • You will not use the Service for an illegal or unauthorized purpose.
  • You will not attempt to interfere with or compromise the security of the Service.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You agree to notify us promptly if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate accounts that violate these Terms or otherwise create a risk to the Service or its users.

Prohibited Activities

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Circumvent or interfere with security features.
  • Upload or transmit malicious software.
  • Use automated scripts, bots, or unauthorized automated access.
  • Attempt to impersonate another person.
  • Sell, transfer, or share your account where prohibited.
  • Interfere with the operation of the Service.
  • Copy, reproduce, modify, or distribute the Service without permission.
  • Reverse engineer, decompile, or disassemble the software except where such restriction is prohibited by applicable law.
  • Use the Service to develop or operate a competing product.
  • Attempt to gain unauthorized access to systems or data belonging to SuperSit or other users.

Section 8

Subscriptions and Payments

Plans and Pricing

  • SuperSit may offer different purchasing options, which may include monthly, yearly, and lifetime access.
  • Current pricing and included features are displayed on the SuperSit website or within the Service at the time of purchase.
  • We reserve the right to change pricing, plans, features, or availability of the Service from time to time.
  • Any applicable price changes to recurring subscriptions will be communicated in accordance with applicable law.

Free Trial

  • SuperSit may offer a 3-day free trial for eligible subscription plans.
  • If you begin a free trial, you authorize the applicable payment provider to process payment according to the terms presented at checkout if you do not cancel before the trial ends.
  • The exact trial and billing terms presented at checkout control your purchase.
  • If you cancel during the free trial, you will not be charged for the subscription, subject to the terms displayed at checkout.

Billing and Payment

  • Subscription payments are processed through the third-party payment provider presented during checkout.
  • By purchasing a subscription, you authorize the applicable payment provider to charge your selected payment method for all applicable fees.
  • You agree to provide accurate and complete billing information.
  • If a payment fails, we may suspend or restrict access to paid features until payment is successfully completed.
  • We are not responsible for fees imposed by your bank, card issuer, or other payment provider.

Auto-Renewal

  • Monthly and yearly subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
  • You may cancel your subscription through the applicable account or billing management system made available to you.
  • After cancellation, you generally retain access to paid features until the end of the current paid billing period, unless otherwise stated at checkout or required by applicable law.

Lifetime Access

  • Where SuperSit offers a lifetime purchase, "lifetime" means the lifetime of the SuperSit product/service offering and does not guarantee that the Service will operate indefinitely or that every future feature will remain available forever.
  • Lifetime purchases are one-time payments and do not automatically renew unless expressly stated otherwise.

Section 9

Cancellation and Refunds

Cancellation

  • You may cancel a recurring subscription at any time.
  • Cancellation prevents future renewal but generally does not automatically entitle you to a refund for a billing period that has already begun, except where required by applicable law or expressly stated in our refund policy.

Refunds

  • Refund eligibility depends on the purchase terms presented at checkout and applicable consumer protection laws.
  • Where SuperSit offers a money-back guarantee, the specific terms and eligibility requirements of that guarantee will apply.
  • Certain digital purchases may be subject to additional cancellation restrictions once digital content or software access has been provided, where permitted by applicable law.

Third-Party Services

The Service may rely on third-party providers for services such as:

Your use of third-party services may be subject to those providers' own terms and privacy policies.

SuperSit is not responsible for the independent actions, policies, or availability of third-party services.

Privacy

We take your privacy seriously.

SuperSit is designed to process posture detection locally on your device where applicable.

We do not intentionally transmit or store webcam footage for posture monitoring.

However, the Service may collect other information necessary to operate features such as accounts, purchases, subscriptions, analytics, support, and product functionality.

Section 12

Health and Safety Disclaimer

SUPERSIT IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY MEDICAL CONDITION.

SuperSit provides posture analysis, reminders, and feedback for general informational and educational purposes.

The Service should not be considered a substitute for professional medical advice, diagnosis, treatment, or an individualized ergonomic assessment.

You should consult an appropriately qualified healthcare professional if you have an existing medical condition, injury, persistent pain, or concerns regarding your posture or musculoskeletal health.

If using SuperSit causes pain, discomfort, dizziness, or other concerning symptoms, stop using the Service and seek appropriate professional advice.

Posture analysis is performed using AI and may not be accurate in every situation.

Accuracy may be affected by factors including:

  • Camera position
  • Lighting
  • Camera quality
  • Clothing
  • Body position
  • Body proportions
  • Environment
  • Device performance
  • Other technical factors

SuperSit does not guarantee that its posture assessments or recommendations will be accurate in every circumstance.

Posture is only one factor in overall physical wellbeing. Regular movement, exercise, stretching, workstation setup, breaks, and other factors may also be important.

Assumption of Risk

You acknowledge that using posture feedback involves changing your physical position and behavior.

You voluntarily assume responsibility for your use of the Service and agree that individual results may vary.

To the fullest extent permitted by applicable law, SuperSit is not responsible for injury, discomfort, strain, or other health issues arising from your use of posture feedback or recommendations.

Nothing in these Terms excludes liability that cannot legally be excluded.

Section 13

Software Updates

SuperSit may automatically download and install software updates.

Updates may include:

  • Bug fixes
  • Security improvements
  • Performance improvements
  • Feature changes
  • New functionality
  • Removal or modification of existing functionality

We are not obligated to maintain any particular feature indefinitely or guarantee backward compatibility with previous versions.

Modifications and Service Availability

We may modify, suspend, or discontinue all or part of the Service at any time.

We may add, remove, or change features and functionality.

We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device or operating system configuration.

Temporary interruptions may occur because of maintenance, updates, technical issues, infrastructure failures, or circumstances outside our reasonable control.

Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUPERSIT DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

  • That the Service will always be available.
  • That the Service will be error-free.
  • That posture detection will always be accurate.
  • That the Service will work in every environment.
  • That you will achieve a particular posture or health outcome.
  • That using the Service will prevent pain, injury, or any medical condition.
  • That the Service will produce any particular result.

AI and Machine Learning

SuperSit uses artificial intelligence and machine learning technology to provide posture analysis and feedback.

AI systems are inherently imperfect and may produce inaccurate or unexpected results.

The accuracy of AI-generated posture assessments may vary depending on camera quality, lighting, positioning, body position, clothing, body proportions, device performance, and other factors.

You acknowledge that AI-generated feedback should not be solely relied upon for decisions concerning your health or wellbeing.

Section 16

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUPERSIT AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

This includes, where legally permitted, loss of profits, revenue, data, business opportunities, or other intangible losses.

To the maximum extent permitted by law, our aggregate liability arising from your use of the Service will be limited to the amount you paid to SuperSit during the twelve (12) months immediately preceding the event giving rise to the claim.

If you have not made any payment to SuperSit, our maximum aggregate liability will be limited to the maximum amount permitted under applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Section 17

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless SuperSit, its owners, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your infringement of another person's rights.
  • Your misuse of the Service.

Section 18

Termination

These Terms remain effective while you use the Service.

We may suspend or terminate your access to the Service if:

  • You materially violate these Terms.
  • We reasonably believe your account has been compromised.
  • Your use of the Service creates a security or legal risk.
  • Required by applicable law.
  • We discontinue the Service.

Upon termination, your right to use the Service will cease.

Any provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

We may retain certain information necessary to provide and operate the Service, including account, transaction, subscription, and usage information as described in our Privacy Policy.

You remain responsible for information you provide to the Service.

You should maintain your own backups of any information you consider important.

Where applicable, you may request deletion of your account and personal information in accordance with our Privacy Policy and applicable law.

You must promptly notify us if you become aware of unauthorized access to your account.

We may suspend or disable an account if we reasonably believe it has been compromised or is being used in violation of these Terms.

These Terms shall be governed by and interpreted in accordance with the laws applicable to the legal entity operating SuperSit, without regard to conflict-of-law principles.

If you are a consumer, nothing in these Terms is intended to remove or restrict mandatory consumer rights that apply to you under the laws of your country or region.

Dispute Resolution

If you have a dispute with SuperSit, we encourage you to contact us first so that we can attempt to resolve the issue informally.

If a dispute cannot be resolved informally, it will be handled according to the applicable laws and dispute-resolution procedures of the governing jurisdiction specified above.

Nothing in this section limits any mandatory consumer rights you may have under applicable law.

Section 25

Force Majeure

SuperSit will not be responsible for delays or failures caused by circumstances beyond our reasonable control.

These circumstances may include natural disasters, war, terrorism, civil unrest, government actions, power failures, telecommunications failures, internet outages, cyber incidents, labor disputes, infrastructure failures, or other events beyond our reasonable control.

Section 26

Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Section 27

Entire Agreement

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and SuperSit concerning your use of the Service.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
